1. Introduction

Welcome to Bartr ("we," "our," or "us"). Bartr is a platform that connects consumers with task-based workers, enabling seamless task completion and income opportunities. By accessing or using our platform, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Definitions

• "Platform" refers to the Bartr website and mobile application.
• "Consumer" refers to users who post tasks and hire workers.
• "Worker" refers to users who complete tasks for consumers.
• "Task" refers to any service or job posted by a consumer.
• "Credits" refers to the virtual currency used on the platform for task payments.
• "User" refers to any person using the platform, whether as a consumer or worker.

3. Eligibility

To use Bartr, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Have the legal capacity to enter into binding contracts.
• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials.
• Comply with all applicable laws and regulations.

4. Account Registration

4.1 Account Creation: You may register using your email address or through Google OAuth. You are responsible for maintaining the confidentiality of your account credentials.

4.2 Dual Roles: Users can operate as both consumers and workers. You can switch between roles within the platform.

4.3 Account Security: You are solely responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

4.4 Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Platform Services

5.1 For Consumers:

• Post tasks with location, budget, and requirements.
• Purchase credits to post tasks on the platform.
• Negotiate rates with workers.
• Make direct payments to workers through any agreed payment method.
• Verify completed work.
• Rate and review workers.

5.2 For Workers:

• Browse tasks within your preferred radius.
• Propose rates and negotiate with consumers.
• Complete tasks and submit for verification.
• Receive payment directly from consumers through any mutually agreed method.
• Pay service charges to Bartr after each task completion.
• Ensure you have received payment from the consumer before marking task as complete.

Important: Workers are solely responsible for ensuring they receive payment from consumers. Bartr does not process, hold, or facilitate worker payments. All payment arrangements are directly between consumer and worker.

6. Credits and Payments

6.1 Credit Purchase: Consumers purchase credits through Razorpay payment gateway to post tasks on the platform. Credits are strictly non-refundable once purchased and tasks are posted.

6.2 Credit Usage: Credits are used to post tasks on the platform. Credits are deducted when both consumer and worker agree on task terms and the task begins.

6.3 Worker Payments: Workers receive payments directly from consumers through any mutually agreed payment method (cash, UPI, bank transfer, etc.). Bartr does not process, hold, or facilitate these payments.

6.4 Service Charges: Workers must pay a service charge to Bartr after each task completion. The service charge amount is displayed in the worker's profile settings.

6.5 Payment Responsibility: Workers are solely responsible for ensuring they receive payment from consumers before marking a task as complete. Bartr is not involved in consumer-to-worker payment transactions.

6.6 No Refunds: Users must be mindful when making payments. Once credits are purchased and tasks are completed, no refunds will be provided except as required by law.

6.7 Payment Disputes: Any payment disputes between consumers and workers must be resolved directly between the parties. Bartr is not responsible for mediating or resolving payment disputes.

Critical Notice: Bartr does not handle, process, or guarantee payments between consumers and workers. All payment arrangements and disputes are solely between the consumer and worker. The platform only facilitates task posting and matching.

7. Task Posting and Completion

7.1 Task Requirements: Consumers must provide clear, accurate task descriptions including location, budget, and requirements.

7.2 Prohibited Tasks: The following tasks are strictly prohibited:

• Illegal activities or services
• Adult or sexually explicit content
• Dangerous or harmful activities
• Fraudulent or deceptive services
• Tasks that violate third-party rights
• Harassment or discrimination

7.3 Task Completion: Workers must complete tasks as agreed. Consumers must verify completion within a reasonable timeframe.

7.4 Cancellation: Either party may cancel before task commencement. Cancellations after agreement may result in penalties.

8. User Conduct

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm other users
• Post false, misleading, or fraudulent content
• Attempt to circumvent platform fees
• Use automated systems or bots
• Reverse engineer or hack the platform
• Share account credentials with others
• Engage in price manipulation or collusion
• Spam or send unsolicited communications

9. Privacy and Data Protection

9.1 Data Collection: We collect personal information including name, email, phone number, and location data to provide our services.

9.2 Data Usage: Your data is used to facilitate task matching, process payments, and improve our services.

9.3 Data Security: We implement industry-standard security measures including encryption, secure sessions, and rate limiting.

9.4 Data Sharing: We do not sell your personal data. We may share data with service providers (Razorpay, database providers) as necessary.

10. Intellectual Property

10.1 Platform Ownership: All content, features, and functionality of Bartr are owned by us and protected by copyright, trademark, and other laws.

10.2 User Content: You retain ownership of content you post but grant us a license to use, display, and distribute it on the platform.

10.3 Trademarks: "Bartr" and our logo are trademarks. You may not use them without our written permission.

11. Disclaimers

11.1 Platform Role: Bartr is a marketplace platform that facilitates connections between consumers and workers. We are NOT a party to any agreements, transactions, or payments between consumers and workers.

11.2 Payment Non-Involvement: Bartr does not process, hold, facilitate, or guarantee payments between consumers and workers. All payment arrangements are solely between the parties involved.

11.3 No Warranties: The platform is provided "AS IS" without warranties of any kind, express or implied. We do not warrant the quality, safety, or legality of tasks or services.

11.4 User Verification: We do not verify the identity, credentials, or background of users. Use caution when engaging with others.

11.5 Service Availability: We do not guarantee uninterrupted or error-free service. Maintenance and updates may cause temporary disruptions.

11.6 Transaction Responsibility: Users are solely responsible for their transactions, agreements, and payments. Bartr has no obligation to monitor, mediate, or resolve disputes.

12. Limitation of Liability

To the maximum extent permitted by law, Bartr shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Actions or omissions of other users
• Quality, safety, or completion of tasks performed
• Payment disputes between consumers and workers
• Non-payment or delayed payment by consumers to workers
• Any financial losses arising from user transactions
• Disputes, disagreements, or conflicts between users
• Unauthorized access to your account
• Third-party service failures (payment gateways, etc.)
• Fraudulent activities by users
• Breach of agreements between consumers and workers

Important: Bartr is not responsible for any issues, disputes, or problems that occur between consumers and workers, including but not limited to payment disputes, task quality, safety concerns, or breach of agreements. All such matters must be resolved directly between the parties involved.

13. Indemnification

You agree to indemnify and hold harmless Bartr, its affiliates, and employees from any claims, damages, losses, or expenses arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Tasks you post or complete
• Disputes with other users

14. Dispute Resolution

14.1 Negotiation: Parties should first attempt to resolve disputes through good-faith negotiation.

14.2 Platform Mediation: We may offer mediation services for disputes between users.

14.3 Governing Law: These Terms are governed by the laws of India.

14.4 Jurisdiction: Any legal action must be brought in the courts of Bangalore, Karnataka, India.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Continued use of the platform constitutes acceptance of modified Terms. We will notify users of material changes via email or platform notification.

16. Termination

16.1 By You: You may terminate your account at any time through account settings.

16.2 By Us: We may suspend or terminate accounts for violations of these Terms, fraudulent activity, or at our discretion.

16.3 Effect of Termination: Upon termination, you lose access to the platform. Outstanding obligations (payments, task completions) remain in effect.

17. General Provisions

17.1 Entire Agreement: These Terms constitute the entire agreement between you and Bartr.

17.2 Severability: If any provision is found invalid, the remaining provisions remain in effect.

17.3 Waiver: Failure to enforce any provision does not constitute a waiver.

17.4 Assignment: You may not assign these Terms without our consent. We may assign them freely.
